Is Tiller Above the Law?
The
battle to protect an unborn child capable of living outside the womb was
decided in 1998 when the Kansas legislature passed a law that placed
restrictions on post-viable abortions.
This
law clearly states that if a baby is capable of living outside the womb-which
is considered over 21 weeks of gestation-then it is illegal to abort the
child. One of the authors of this legislation was Representative Phill Kline.
Each
year, statistical information on abortions was reported annually to the Kansas
Department of Health and Environment. These reports show that the late-term
abortions prohibited by the 1998 law not only did not cease, but have
increased.
The
number of illegal abortions performed during this time is estimated at 2,519,
with the vast majority of these abortions having been performed by George
Tiller, the medical director of an abortion clinic in Wichita, KS that
specializes in the provision of late-term procedures.
In
2002, Phill Kline was elected as the Attorney General of Kansas. Being aware
of the situation, Attorney General Kline launched an inquiry into the
enforcement of post-viable abortion laws. To date, the battle of enforcement
of said law continues.
Lawyers
representing Tiller have successfully managed to delay the investigations into
Tiller’s practice. Ultimately, after considerable delay brought about by the
Kansas Supreme Court, the Kansas Attorney General’s office (post Phill Kline),
and the Sedgwick County District Attorney’s office, it became apparent that it
was going to be up to the citizens of Sedgwick County to force an investigation
into violations of the law concerning abortion by petitioning a grand jury.
